Separate the question of whether a qualifying charge can be opted out from the question of whether another ISP can actually serve the apartment. AB 1414 does not itself create network availability.
Start with the documents, not the word “mandatory”
Review the executed lease, internet or technology addendum, rent ledger and resident portal. Determine whether the amount is for a third-party ISP subscription, a broader amenity package or another service. California AB 1414 can be relevant to qualifying third-party ISP subscriptions, but the facts and tenancy timing still matter.

- The ISP or company supplying the service
- Lease commencement or renewal date
- Any written opt-out instructions or management response
